This is where we can discuss the 3-minute topics for the April 15th City Council meeting and who the speaker should be for each topic.

    Here is a list of some of the topics to be discussed at the April 15 Council meeting:

    1. Council has not corrected the non-conformance between the zoning ordinance and and planning documents.
    2. Michigan Zoning Enabling Act, MCL 125.3203(1) prescribes requirements for a zoning ordinance: “A zoning ordinance shall be based on a plan. . .to ensure that uses of the land shall be situated in appropriate locations and relationships, . . .to provide adequate light and air.”
    3. The developers have submitted a site plan with a USE that is permitted in these zoning districts BY RIGHT. No one can tell the developer he cannot put a residential project here, if that use is permitted. The rest is up to the interpretation and discretion of the City staff and planning commission, and ultimately in most cases, city council.
    4. The City Code provides the standards for approving a site plan in Chapter 57 section 5:122(6): “Standards for site plan approval. A site plan shall be approved by the appropriate body after it determines that: (c) The development would not cause a public or private nuisance and would not have a detrimental effect on the public health, safety or welfare.”
    5. By basing a decision only on zoning, it establishes the irrelevance of all other steps in the planning process.
    6. The city did not fulfill its obligation to review D1 zoning.
    7. Planning Commission recommended denial.
    8. “There cannot be any dispute that the development as presently proposed in its massing and out-of-scale size is incompatible with adjoining historic districts and would be detrimental to the public welfare as declared by this City’s prior findings and statements.”

    9. This Character District specifies a setback.
    10. Underground parking structure is a Special Use and requires a separate approval process.
    11. Cranes would trespass over other properties.
    12. No description of retaining wall against Sloan Plaza.
    13. There is not an adequate area for trash removal.
    14. No provision for Move-in, Move-out days for students.
    15. Chris Graham has stated the development will cause the death of legacy trees on the north side of the structure.
    16. No details are provided on the underground retaining wall at Sloan Plaza property line.
    17. Protection of foundation for Tyler carriage house.
    18. Excessive noise during construction.
